DMCA Policy

1. Introduction

Look Ma I'm Famous ("LMIF," "we," "our," or "us") respects the intellectual property rights of others and expects users of our Services to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines our procedures for responding to notices of alleged copyright infringement in accordance with the DMCA (17 U.S.C. § 512).

2. Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our Services, please notify our Designated DMCA Agent. For your notice to be effective, it must include the following information:

  • Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  • Identification of the infringing material: A description of the material that you claim is infringing and where it is located on our Services, with enough detail for us to locate it (such as a URL or specific location).
  • Your contact information: Your name, address, telephone number, and email address.
  • Statement of good faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Statement of accuracy: A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.
  • Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

4. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent. Your counter-notification must include:

  • Identification of the material: A description of the material that was removed or disabled and where it appeared before removal.
  • Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your contact information: Your name, address, telephone number, and email address.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or San Francisco County, California, if you are outside the United States), and that you will accept service of process from the person who filed the original DMCA notice or their agent.
  • Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action seeking to restrain you from the allegedly infringing activity, we may restore the removed material.

5. Repeat Infringer Policy

In accordance with the DMCA, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our Services and/or terminate the accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. Identity Rights vs. Copyright

LMIF's primary mission is protecting identity rights (likeness, voice, and image). While this DMCA Policy addresses traditional copyright concerns, please note:

  • For AI-generated content using your likeness: If unauthorized AI-generated content uses your claimed identity, you should use our identity protection tools and reporting mechanisms rather than the DMCA process.
  • For copyrighted works: The DMCA process described here applies to traditional copyright infringement (photos, videos, written content, etc.).

7. Modifications

We reserve the right to modify this DMCA Policy at any time. We will notify users of any material changes by posting the updated policy and changing the "Last updated" date. Your continued use of our Services after any changes indicates your acceptance of the modified policy.
